Impakt uses a variety of managerial, technical, and physical measures to protect the integrity and security of your information. These measures may vary based on the sensitivity of your information. However, no security precautions or systems can be completely secure. We cannot ensure or warrant the security of any information you transmit to Impakt, and you do so at your own risk. We cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Impakt may suspend, restrict, or terminate an account—and may withhold, reverse, or invalidate any pending or unpaid earnings—if it determines, in its sole discretion, that the user has violated these Terms, engaged in fraudulent, manipulative, or abusive conduct, or otherwise acted contrary to Impakt's legitimate business interests. Such determinations are final except where prohibited by applicable law.

Any dispute relating to earnings or payouts must be submitted in writing to Impakt within thirty (30) days of the disputed transaction. Failure to submit within this period constitutes a permanent waiver of the claim. All disputes will be reviewed internally by Impakt, and Impakt's determination shall be final and binding, except where prohibited by law.

Impakt reserves the absolute right to amend, suspend, or discontinue any monetization, referral, or earnings-related feature at any time and for any reason, with or without notice. Continued use of the platform constitutes acceptance of such modifications.

Impakt provides tools and opportunities that may allow users to earn earnings, but makes no promise, representation, or guarantee regarding financial results. Earnings potential depends on factors outside Impakt's control, including individual effort, user behavior, and market conditions. Any projections, statistics, or illustrative earnings displayed are hypothetical, non-binding, and provided for informational purposes only.

All displayed or reported earnings within the Impakt platform, including commissions, referral earnings, or other performance-based earnings, are for informational purposes only. Such figures are not legally binding and do not constitute a guarantee or entitlement to payment. All payout amounts, eligibility criteria, and calculation methodologies are determined solely by Impakt. Impakt retains full and final discretion to interpret, modify, adjust, or revoke any earnings, and its determinations shall be conclusive and binding.

Participation in Impakt's referral or affiliate programs constitutes acceptance of all applicable monetization rules. Referrals and earnings are tracked solely by Impakt's internal systems, and Impakt's data shall prevail in the event of any discrepancy. Impakt reserves the unrestricted right to withhold, adjust, reduce, or cancel earnings that it determines to be fraudulent, duplicative, self-generated, abusive, or inconsistent with program intent.

All earnings are subject to a minimum sixty (60) day settlement period following a qualifying transaction. This period allows for payment verification, fraud review, refund reconciliation, and chargeback prevention. Impakt may extend or modify settlement timelines at its sole discretion, without prior notice, to protect the integrity of the platform or to comply with payment-provider or regulatory requirements.

Users are solely responsible for determining, reporting, and remitting any taxes, duties, or other assessments related to earnings received through Impakt. Impakt does not provide tax advice, does not withhold taxes on behalf of users unless legally required, and assumes no liability for any resulting tax obligations or penalties. Users agree to indemnify and hold Impakt harmless from any related claims.

If a payout or transaction requires currency conversion, the applicable rate and any associated conversion fees will be determined at Impakt's sole discretion or by its payment processor at the time of transfer. Users are responsible for any additional fees charged by their financial institution, payment service, or intermediary bank.

Impakt shall not be liable for any losses, discrepancies, or perceived shortfalls arising from currency exchange rate changes between the time earnings are displayed and the time they are paid out. All payouts are final once issued in the chosen settlement currency.

All transactions, earnings, and payouts within the Impakt platform are calculated and recorded in United States Dollars (USD), unless otherwise stated. Any amounts displayed in other currencies are provided for convenience only and are based on exchange rates available at the time of display.

Exchange rates are determined using third-party financial data providers selected by Impakt. Impakt does not guarantee the accuracy, timeliness, or reliability of these rates, and actual conversion rates applied during payout may differ from displayed values due to market fluctuations or processing fees.

In the event that Impakt, or some or all assets related to the Impakt Services are acquired by or merged with a third-party entity or in connection with a contemplated change of ownership transaction, we reserve the right, in any of these circumstances, to transfer or assign the information that we have collected from users as part of that merger, acquisition, sale, or other change of control event, including in the course of diligence.

Information collected by Impakt may be stored and processed in your region, in the United States (for instance in our major data centers), or in any other country where Impakt or its affiliates, subsidiaries, partners, or service providers are located or maintain facilities. If we provide any information about you to any such entities, we will take appropriate measures to ensure such companies protect your information adequately in accordance with this Privacy Notice and applicable law.

If there is any discrepancy between the language presented in another location and the provisions contained here, the terms of this Privacy Policy & Terms shall govern and control in all cases. Impakt reserves the right to interpret its own policies, determine their application, and resolve any ambiguities at its sole discretion.

In the event of any conflict or inconsistency between these Privacy Policy & Terms and any other information, statement, policy, or content appearing elsewhere on the Impakt website, within the Impakt app, or in any related communication, these Privacy Policy & Terms shall prevail.

This includes, without limitation, any marketing materials, promotional content, in-app notices, FAQs, help articles, social media posts, or user-generated descriptions that may describe Impakt's features, programs, or rewards differently from these Terms.

All usernames, account names, and vanity URLs associated with Impakt Services are and remain the sole property of Impakt Inc. By creating an account or selecting a username or vanity URL, users acknowledge that they have no ownership or proprietary rights over these identifiers. Impakt reserves the right to modify, reclaim, or remove any username, account name, or vanity URL at its sole discretion, including but not limited to cases of impersonation, trademark infringement, inactivity, or any violation of Impakt's policies. Users may not sell, transfer, or license their username, account name, or vanity URL without explicit written consent from Impakt.

When you access the Impakt Services or open one of our emails, we automatically record and store certain information about your system by using cookies and other types of technologies. Cookies are small text files containing a string of alphanumeric characters that are sent to your browser. For information about what cookies are, how they work, how Impakt uses them, and how to remove them, please contact Impakt via support on www.impakt.com. Examples of such information we automatically collect include Internet Protocol address ("IP Address"), a unique user ID, device and browser types and identifiers, referring and exit page addresses, software and system type, and information about your usage of Impakt Services. Examples of how Impakt uses automatically collected information include to: (a) automatically update the Impakt application on your system; (b) remember your information so that you will not have to re-enter it during your visit or the next time you access the Impakt Services; (c) monitor and store aggregate site usage metrics such as total number of visitors and pages accessed; and (d) track your entries, submissions, and status in any promotions or other activities.

We may obtain additional information from third parties and sources other than the Impakt Services. For example, we may obtain additional information from advertisers, games or services you use, or social media networks for which you have approved our access. When you access the Impakt Services through social media networks or when you connect the Impakt Services to social media networks, you are authorizing Impakt to collect, store, and use such additional information and content in accordance with this Privacy Notice. We may also obtain information from third-party services regarding your use of such services, including about your use of the content you choose to broadcast through the Impakt Services. We use this information to supplement the information we collect about you in order to provide more relevant, safer experiences for you with the Impakt Services and improve the Impakt Services, analytics, and advertising. If we combine or associate information from other sources with information that we collect through the Impakt Services, we will treat the combined information in accordance with this Privacy Notice.

You may provide a variety of information about yourself to us, such as your name, voice, and image (in any content you upload), Impakt username, email address, postal mailing address, telephone number, credit card number, and billing information when you register for Impakt Services; upload, purchase, view, or download certain content or products from the Impakt Services; enter contests or sweepstakes; or otherwise use the features and functionality of the Impakt Services.

Engaging in any improper activities, including but not limited to manipulating exercises (e.g., sitting on chairs for holds), falsifying exercise routines, using automated systems or bots, creating multiple accounts to gain an unfair advantage, or any other form of deceitful conduct, is strictly prohibited. This includes actions taken for financial gain, leaderboard manipulation, or any other form of unfair advantage. Violations may result in suspension, shadow banning, or termination of the responsible accounts and associated accounts, as well as the forfeiture of any potential or accrued rewards.

Impakt maintains data related to your usage of Impakt for as long as it is required in order to fulfill the relevant purposes described in this Privacy Notice, as may be required (or permitted) by law such as for tax and accounting purposes, or as otherwise communicated to you. Once you have asked us to close your account and delete your profile information, we will delete all information that we are not required or permitted to retain by law.

Videos are stored locally by default and are not uploaded online. If you choose to share your videos on the Impakt platform, they will become publicly available on our app and website. Once uploaded, these videos may also be featured in our newsletters and on our social media channels (including, but not limited to, X, Instagram, YouTube, TikTok, etc.) to showcase the dynamic and engaging nature of Impakt activities and our community.
